Terms and Conditions

Terms and Conditions

These terms govern the use of aquinoxyachting.com and any enquiry for yacht charter, sale and purchase or agency services made through Aquinox Yachting. By using the site or sending us an enquiry you accept these terms.

1. Who we are

Aquinox Yachting is a yacht brokerage and charter consultancy with offices at Merkez Mahallesi İzzetpaşa Sk. No:12/1 Şişli/İstanbul, Turkey, and Carrer de Palamos 7, Gava Mar, Barcelona, Spain 08850. Yacht charters in Turkey are contracted through our TÜRSAB-licensed partner, UCT Agency. Contact: info@aquinoxyachting.com · +90 549 507 19 93

2. What we do

Aquinox Yachting acts as an intermediary and broker between yacht owners or operators and guests. Unless stated otherwise in writing, the yachts are not owned or operated by Aquinox Yachting. The charter service itself is provided by the owner or operator named in the signed charter agreement.

3. Listings, prices and availability

  • Listing details, photographs and specifications are supplied by owners and central agents. We take care with them, but they can change and are confirmed before contract.
  • Prices shown are "from" rates and vary with season, route, party size and duration. "Per person" prices are for guidance only: the weekly yacht rate divided by the listed maximum number of guests. Charters are booked per yacht, not per person.
  • Unless stated otherwise, prices exclude VAT, fuel, port and marina fees, food and drink (APA) and gratuities.
  • Availability is not guaranteed until the contract is signed and the first payment received. Provisional options are valid only in writing and for the period stated.

4. Booking and payment

A booking is confirmed by a charter agreement signed by the parties (usually the MYBA or an equivalent standard contract). Deposit and balance amounts, due dates and payment method are set out in that agreement. If the agreement and these terms conflict, the charter agreement prevails.

5. APA (Advance Provisioning Allowance)

On crewed charters, running costs such as fuel, provisions and port fees are usually covered by an APA, paid in addition to the charter fee as a percentage of it. The captain accounts for the APA with receipts at the end of the charter; any unused balance is refunded and any shortfall is settled.

6. Cancellation and changes

Cancellation, date changes and refunds follow the signed charter agreement. The captain decides on route changes for weather and sea conditions; changes made for safety are not grounds for a refund. We recommend travel and cancellation insurance.

7. Guest responsibilities

  • Provide the guest list (name, passport, nationality) required for port and customs formalities on time,
  • Follow the captain's safety instructions and not exceed the yacht's licensed capacity,
  • Be responsible, as set out in the agreement, for damage to the yacht, its equipment and water toys,
  • Refrain from illegal substances and activities; otherwise the captain may end the charter without refund.

8. Yachts for sale

Sale listings are based on information supplied by the seller and are not an offer for sale. All details must be verified by survey, sea trial and a sale and purchase agreement. The seller may change the price and the yacht may be sold without notice.

9. Limitation of liability

To the extent permitted by applicable law, Aquinox Yachting is not liable for loss arising from the acts or omissions of the yacht owner or operator, the crew or third-party providers (transfers, accommodation, restaurants and similar), from force majeure or from weather. Content on this site is for information only.

10. Intellectual property

Text, logos, design and photographs on this site belong to Aquinox Yachting or its licensors and may not be copied or used commercially without permission.

11. Personal data

How we process your personal data is explained in our Privacy Policy.

12. Governing law

These terms are governed by Turkish law and the courts and enforcement offices of Istanbul (Central) have jurisdiction. The statutory rights of guests acting as consumers are not affected. Where the charter agreement sets a different governing law or jurisdiction, that applies.

13. Changes

We may update these terms from time to time; the current version is always published on this page. Questions: info@aquinoxyachting.com
